The Health Insurance Portability and Accountability Act of 1996 (HIPAA), Public Law 104-191, was enacted on August 21, 1996. Sections 261 through 264 of HIPAA require the Secretary of HHS to publicize standards for the electronic exchange, privacy and security of health information.

HIPAA guidelines require the Secretary to issue privacy regulations governing individually identifiable health information. The HIPPA Privacy Act applies to health plans, health care clearinghouses, and to any health care provider who transmits health information in electronic form in connection with transactions for which the Secretary of HHS has adopted standards under HIPAA.

The Privacy Rule requires that providers put safeguards in place to protect their patients’ privacy.

It’s because of the Privacy Rule that patients have legal rights over their health information.

These include three fundamental rights:

First, the right to authorize the disclosure of their health information and records. Second, the right to request and examine a copy of their health records at any time. Third, patients have the right to request corrections to their records as needed.

Simply put, there are required safeguards for the information collected that go above and beyond the usual data processing workflow.

And while drug testing companies may opt for the best affordable security for their data, without constant upgrades and maintenance, they may be vulnerable to a data breach.
